There’s absolutely no situation which absolutely needs a private immigration attorney. Be careful not to misread that. I didn’t state that immigration lawyers are not valuable; they just are not required. There are several great reasons why people hire immigration lawyer Toronto:
- Immigration law is complex
In 2005, the Congressional Research Service reported: “The statutory scheme defining and delimiting the rights of aliens is extremely intricate. Courts and commentators have said that the Immigration and Nationality Act resembles ‘King Mino’s labyrinth in ancient Crete,’ and is ‘second only to the Internal Revenue Code in sophistication.’
Finding someone who will navigate the complex immigration laws may mean the difference between having the ability to live and work in the U.S. and being forced to leave. Legacy INS Spokesperson Karen Kraushaar said that “immigration law is a puzzle and a mastery of obfuscation, and the attorneys who can figure it out are worth their weight in gold.”
There are, however, some immigration lawyers who either can’t or at least haven’t yet figured it out. In a law review article written by Judge Richard Posner of the Seventh Circuit Court of Appeals and Northwestern University Law Professor Albert Yoon, it’s noted that a panel of judges were asked which area of the law had the lowest grade attorneys. The judges “agreed that immigration law was the region where the quality of representation was lowest.”
The lesson from all of this? Yes, immigration law is complicated, but it’s essential to obtain an immigration lawyer who can figure it out.
- Immigration attorneys can fend off future immigration issues
Due to the complexity of immigration law, it is difficult for people trying to deal with an immigration situation by themselves to get up to speed on regulations. This is particularly important if time is running against you, which it almost always is in immigration issues. Retired U.S. Supreme Court Justice John Paul Stevens has said in the context of detained immigrants who “the demand for legal representation for immigrants has grown so severe and the consequences so extreme that something has to be done.” If immigration attorneys are unworthy, then a U.S. Supreme Court Justice would not have made such a comment.
People sometimes think they don’t need an immigration lawyer because they do not have any immigration issues. For a good deal of people, that could be true. But for some folks, it’s not that they don’t have immigration issues, but it’s that they don’t understand that they have immigration issues. “Oh? You mean that if I leave the U.S. right now I will not have the ability to come back for a decade?” Yes, I’m sorry. If this person had seen an immigration lawyer a year ago, there might have been something the lawyer would have advised so as to stop her present immigration predicament. Not seeing a lawyer when in doubt could lead to a lot of “could have, could have, should have” statements.
- Immigration attorneys do it better
Statistics can be misleading and suspicious, so I really don’t like using them gently. However, the numbers that I am going to share with you are verifiable and are worth your attention. Lawyers can’t guarantee a successful outcome in any situation. In actuality, attorneys should specifically say to each new client that “I can’t guarantee a successful outcome in your case.”
Statistics aren’t meant to be utilized as a sales pitch to a customer wondering whether or not she should hire an immigration attorney, or whether to hire you or I as her attorney. Rather, they are intended to present a wake-up call to the customer, in essence saying, “Immigration law is complex. You can do it by yourself or you could hire a lawyer to guide you.” If remaining at the U.S. is important to the customer, the choice is clear.
Immigration lawyers do a lot more than just fill out immigration forms. We can spot immigration issues before they happen, and advise a customer accordingly. When we think the client doesn’t have a fantastic case, we inform them, and suggest ways so as to construct a stronger case. When we must fight the authorities, we prepare legal briefs in support of our discussions and also make appearances in immigration and consular officers together with our customers. We provide strategies for successful results at immigration interviews, and notify customers of possible pitfalls to avoid at these interviews. As you can see, all of the evidence supports the case that immigration attorneys are invaluable.
